The Dead Kennedys formed in San Francisco in 1978; consisting of East Bay Ray, Klaus Flouride, and drummer Ted alongside Jello Biafra.

"California Über Alles" was first released as a single on Optional Music in 1979, targeting California Governor Jerry Brown. When Ronald Reagan took office, Jello Biafra rewrote it as "We've Got a Bigger Problem Now," recorded for the 1981 EP In God We Trust, Inc. on the band's own Alternative Tentacles label, retaining the original's structure while redirecting its target.

The "Now It Is 1984" line drew on Orwell's novel as a framework for Reagan-era surveillance and social control.
